This Notice is provided by Automation Anywhere, Inc. and its subsidiaries and affiliate (together “AAI,” “we,” “us” or “our”).
For the purposes of this Privacy Notice only, “Personnel”, “you” or “your”, means job applicants, employees, owners, directors, officers, or contractors of AAI. If you are a California resident, please review the California-specific section below.

How Personal Information is Collected About You
We collect personal information directly from you when you provide it to us, when you provide it to Workday or other human resources systems, when you apply for a position with AAI, and from our vendors and recruiters.
We also collect personal information using technology to monitor, protect and manage AAI networks, AAI systems, and AAI information, as well as using technology to discover processes which could be automated.
If you visit an Automation Anywhere website or interact with an AAI advertisement, AAI or our partners may use cookies, web beacons, clear GIF, pixels, internet tags, web server logs, and other data collection tools as further described in our Automation Anywhere Website Privacy Policy.
How AAI Uses Your Personal Information
In addition to the purposes and uses described elsewhere in this Notice, we may process your personal information for the following business purposes:
How AAI Discloses Your Personal Information.
Within AAI. We may disclose your personal information internally within AAI and among AAI’s affiliates for purposes of recruiting and/or evaluating applicants, resource planning, and talent and recruiting, human resources and business administration functions.
Customers. We may disclose your personal information with our customers in connection with our business activities.
Service Providers. AAI may disclose personal information with third-party service providers or suppliers ("Service Providers") that include, without limitation, data storage providers, website or mobile application hosting providers, and e-mail service providers as needed to provide the applicable services to us. AAI will take steps to help ensure appropriate protections are in place before we disclose personal information with any Service Provider.
Service Providers. AAI may disclose personal information with third-party service providers or suppliers ("Service Providers") that include, without limitation, data storage providers, website or mobile application hosting providers, and e-mail service providers as needed to provide the applicable services to us. AAI will take steps to help ensure appropriate protections are in place before we disclose personal information with any Service Provider.
Legal Requirements. AAI may disclose personal information in order to cooperate with law enforcement and other governmental agencies, to protect the rights and property of AAI, our customers, and the public, and to detect and respond to suspected illegal activity and threats to the safety of any person or of our systems, services, or property.
Professional Advisors. We may disclose personal information with our professional advisors, such as our attorneys and accountants, in their capacity as advisors, including for advice on potential or actual litigation matters.
Change in Ownership. We may use and disclose personal information in connection with the evaluation of a change of control of AAI such as in the event of a merger, acquisition, or sale of assets. We may provide personal information both in connection with a due diligence process or it could be transferred as part of the change of control to subsequent owner(s). If we (or our assets) are acquired or if we go out of business, enter bankruptcy, or go through some other change of control or reorganization, personal information and other information could be one of the assets transferred to or acquired by a third party, or reviewed as part of the due diligence process.

You will not be discriminated against in any way by virtue of your exercise of the rights listed in this Notice.
Verification: We must verify your identity before fulfilling your requests. If we cannot initially verify your identity, we may request additional information to complete the verification process. We will only use personal information provided in a request to verify the requestor’s identity. If you are an authorized agent making a request on behalf of a California consumer, we will also need to verify your identity, which may require proof of your written authorization or evidence of a power of attorney.
We endeavor to respond to requests within the time period required by applicable law. If we require more time, we will inform you of the reason and extension period in writing.
We will deliver our written response electronically via e-mail.
We do not charge a fee to process or respond to your request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
We cannot respond to your request or provide you with personal information if we cannot verify your identity and confirm the personal information relates to you. Making a verifiable data subject access request does not require you to create an account with us.
We may deny certain requests, or only fulfill some in part, as permitted or required by law. For example, if you request to delete personal information, we may retain personal information that we need to retain for legal purposes.
How Long Does AAI Retain Your Personal Information.
Personal information will be stored in accordance with applicable laws and kept as long as needed to carry out the purposes described in this Privacy Notice or as otherwise required by applicable law, taking into consideration any statutorily required minimum periods of time in applicable jurisdictions. Generally, this means your personal information will be retained until the end or your employment, or work relationship with us plus a reasonable period of time thereafter to respond to employment or work-related inquiries or to deal with any legal matters, document the proper termination of your employment or work relationship, or to provide you with any ongoing benefits.
Changes to this Privacy Notice.
This Privacy Notice may be amended consistent with the requirements of applicable law. When AAI updates this Privacy Notice, it will also revise the “Last Updated” date at the top of this document. Check back periodically as we will make updates to this Privacy Notice and revise the date updated to indicate the date last updated. Furthermore, AAI will notify Personnel regarding any material changes to this Privacy Notice. The Privacy Notice will be posted on AAI’s intranet and in Workday.

Introduction
Purpose
The purpose of this Privacy Notice for Personnel in the UK, EEA, and Switzerland (“Privacy Notice”) is to describe how Automation Anywhere, Inc., and its affiliated companies (the “Company”) collects and uses the Personal Data of its workforce, and meets its data protection obligations under the General Data Protection Regulation (“GDPR”) and, where applicable, the UK Data Protection Act 2018 (the “UK Act”), or the Swiss Federal Act on Data Protection of June 19, 1992 (the “FADP”). This Privacy Notice sets out the Company’s commitment to data protection, and individual rights and obligations in relation to Personal Data, to the extent applicable under GDPR, FADP and/or the UK Act.
This Privacy Notice applies to the Personal Data of:

Definitions
"Criminal Records Data" means information about an individual's criminal convictions and offences, and information relating to criminal allegations and proceedings.
“Data Subject” means an identified or identifiable natural person. For purposes of this Privacy Notice, Data Subject shall be restricted to any current and former Personnel, including but not limited to, temporary and permanent employees, retirees, and other former employees as well as dependents of such employees.
"Personal Data" is any information that relates to a living individual who is either identified (i.e., known to Company) or is identifiable directly or indirectly.
“Processing” is any use that is made of data, including collecting, storing, amending, disclosing or destroying it.
"Special Categories of Personal Data" means information about an individual's racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, health, sex life or sexual orientation and genetic and biometric data.

The Company processes the above Personal Data pursuant to the Company’s legitimate interests and in compliance with the Company’s legal and regulatory obligations. If the Personal Data the Company collects is considered a special category of data, such Personal Data is collected in accordance with the Company’s employment obligations. If the Company intends to use Personal Data for purposes outside of the Company’s legitimate interests, employment obligations, or legal and regulatory obligations, the Company will identify a separate legal basis, which may include obtaining consent.
The Company limits the collection, use, and retention of Personal Data to that which is required for the intended purposes for which it was collected or authorized by the Data Subject.

Data Subjects have a number of rights in relation to their Personal Data. These rights include the right to:

In some cases, the Company may need to ask for proof of identification before the request can be processed. The Company will inform the individual if it needs to verify his/her/their identity and the documents it requires.
The Company will normally respond to a request within a period of one month from the date it is received. In some cases, such as where the Company processes large amounts of the individual's Personal Data, it may respond within three months of the date the request is received. The Company will write to the individual within one month of receiving the original request to tell him/her/them if this is the case.
If an access request is manifestly unfounded or excessive, the Company is not obliged to comply with it. Alternatively, the Company can agree to respond but may charge a fee to cover the administrative cost of responding to the request. A subject access request is likely to be manifestly unfounded or excessive where it repeats a request to which the Company has already responded. If an individual submits a request that is unfounded or excessive, the Company will notify him/her/them that this is the case and whether or not it will respond to it.
Data security
The Company takes the security of HR-related Personal Data seriously. The Company has internal procedures and controls in place to protect Personal Data against loss, accidental destruction, misuse or disclosure, and to ensure that data is not accessed, except by associates in the proper performance of their duties. This includes limiting access to HR and Legal personnel only.
Where the Company engages third parties to process Personal Data on its behalf, such parties do so on the basis of documented instructions, are under a duty of confidentiality, and are obliged to implement appropriate measures to ensure the security of Personal Data.
Accountability for Onward Transfers
Prior to disclosing Personal Data to a third party, the Company shall notify the Data Subject of such disclosure and allow the Data Subject the choice to opt-out of such disclosure unless the disclosure is required and permitted under applicable law or regulation to which Company is subject, or is made to a third party processor acting on behalf, and subject to the instructions, of the Company. The Company shall enter into contracts to ensure that any third party to whom Personal Data may be disclosed, is aware of and adheres to applicable data protection laws and agrees to provide an adequate level of privacy protection. The Company shall also, upon notice, take reasonable and appropriate steps to stop and remediate unauthorized Processing by a third party.
Personal Data may be transferred to, and processed in, countries outside of the UK, EEA and Switzerland. Such Personal Data may be transferred outside the UK, EEA and Switzerland on the basis of the Company’s legitimate business interests and/or, where appropriate, pursuant to the UK International Data Transfer Addendum to the EU Commission Standard Contractual Clauses or European Commission’s standard contractual clauses.
Recourse, Enforcement, and Liability.
The Company periodically verifies that this Privacy Notice is accurate and comprehensive, is properly disseminated to Personnel and is implemented and accessible. The Company encourages interested persons to raise any concerns using the contact information provided below and will investigate and attempt to resolve any complaints and disputes regarding use and disclosure of Personal Data in accordance applicable law.
While the Company encourages individuals to first reach out to the Company using the information in Section 9, individuals may engage their local Data Protection Authority (including the UK Information Commissioner’s Office and the Swiss Federal Data Protection and Information Commissioner) and/or, where applicable their local Labour Authority, concerning adherence to the GDPR, the UK Act, and FADP, and the Company shall respond directly to such authorities with regard to investigations and resolution of complaints.

This Privacy Notice may be amended consistent with the requirements of applicable law. Pour exercer les droits énumérés ci-dessus, les Personnes concernées doivent adresser leur demande à privacy@automationanywhere.com.
Dans certains cas, la Société peut être amenée à demander une preuve d'identification avant de pouvoir traiter la demande. La Société informera la personne de la nécessité de vérifier son identité et des documents dont elle a besoin.
En principe, la Société répondra à une demande dans un délai d'un mois à compter de la date de sa réception. Dans certains cas, par exemple, lorsque la Société traite de grandes quantités de Données à caractère personnel d'une personne, elle peut répondre dans les trois mois suivant la date de réception de la demande. La Société écrira à la personne concernée dans un délai d'un mois à compter de la réception de la demande initiale pour lui indiquer si tel est le cas.

Si une personne soumet une demande non fondée ou excessive, la Société l'en informera et lui indiquera si elle y répondra ou non.
Sécurité des données
La Société prend au sérieux la sécurité des Données à caractère personnel dans le cadre des ressources humaines. La Société a mis en place des procédures et des contrôles internes pour protéger les Données à caractère personnel contre la perte, la destruction accidentelle, l'utilisation abusive ou la divulgation, et pour s'assurer que les données ne sont pas accessibles, sauf par les associés dans l'exercice correct de leurs fonctions. Il s'agit notamment de limiter l'accès aux seuls membres du personnel RH et juridique.
Lorsque la Société engage des tiers pour traiter des Données à caractère personnel en son nom, ces derniers agissent sur la base d'instructions documentées, sont soumis à un devoir de confidentialité et sont tenus de mettre en œuvre des mesures appropriées pour assurer la sécurité des Données à caractère personnel.
Responsabilité des transferts ultérieurs
Avant de divulguer des Données à caractère personnel à un tiers, la Société doit informer la Personne concernée de cette divulgation et lui donner la possibilité de la refuser, à moins que la divulgation ne soit requise et permise par la loi ou la réglementation applicable à laquelle la Société est soumise, ou qu'elle ne soit faite à un sous-traitant tiers agissant pour le compte de la Société et soumis à ses instructions. Privacy Notice – Mexico Personnel

Your data is important to us. This Privacy Notice (“Notice”) explains what personal data we collect, how we collect it, and how we use your personal data. This Notice is provided by Automation Anywhere, Inc., with address at: 633 River Oaks Parkway, San Jose, CA 95134 U.S.A. and Workforce Digital, S.A. de C.V. with address at: AV. Insurgentes Sur #1425, Piso 16, Oficina A, Col. Insurgentes Mixcoac, Alcaldía Benito Juárez, Ciudad de Mexico, C.P. 03920, Mexico (together “AAI,” “we,” “us” or “our”).
Pursuant to the Federal Law for the Protection of Personal Data Held By Private Entities (“FDPL”), employees, applicants and contractors (“Personnel”, “you” or “your”) have a right to know, at or before the point of collection, what categories of personal information will be collected and the purposes for which the categories of personal information will be used.
Personal Information AAI May Collect About You
Identifying information which you provide to us: name, title, telephone number, age, date of birth, signature, driver’s license number or other state identification number, passport number, social security number, bank account number, secondary health insurance information (if applicable), mailing address, and email address, citizenship, marital status, household information and veteran or military status.
Demographic and physical information, some of which is protected as sensitive personal data: race, national origin, religion or creed, medical condition, pregnancy and related medical conditions, vaccination status, physical or mental disability, gender identity and sex.
Video, voice and image data, subject to the requirements of local law and internal policy.
Where applicable, device information, geolocation, and other unique identifiers that we or AAI systems, AAI network, or AAI agents (such as OKTA) collect about you such as physical location or movements, internet protocol address or any other unique number assigned to identify the device, when a device is used to access AAI information, AAI network, AAI systems, or a website belonging to AAI.
Where applicable, activity performed on an AAI owned network or device such as browser type and version, applications installed and usage patterns, software updates installed, browser history, search history, email content, other electronic communication content, file and document content, keystrokes, clicks and other navigational patterns, desktop screen shots and other information regarding Personnel’s interaction with an internet website, AAI computer, AAI’s network, systems, or AAI information. Employees and contractors can refer to the Automation Anywhere Information Technology Acceptable Use Policy and Process Discovery FAQs for more information.
Where applicable, activity performed on a non-AAI owned device on which you have installed AAI’s mobile device management (MDM) such as device type used to access AAI network, AAI systems or AAI information, device identifier including device name, model, serial number, storage amount total and free, IMEI, MAC address, and operating system, AAI-managed applications installed on the device and the information and activities therein. Please note that AAI does not collect your browsing history, calling history, text messages, contacts, passwords to personal accounts, content in your personal applications, personal calendar events, or photos from the non-AAI owned device.
Where applicable, facility security data such as facility access data, on-premises video monitoring, and photo IDs used for identity verification and security purposes.
Job applicant and other Personnel onboarding information not previously addressed such as education history; job preferences; information obtained during reference checks, background checks or other screenings; information from publicly available sources, such as LinkedIn; emergency contacts; and employment information including your employment history, language skills and professional qualifications, any other information included on your resume or CV. Additionally, for Personnel onboarding, information provided to AAI such as year to date 401k contributions; tax forms for payroll deductions; whether you were referred to AAI by a specific job website or person; any security, discrimination, harassment, facility or other training taken through AAI vendors during your relationship with AAI; and opinions collected while answering any voluntary surveys sent to you by AAI.
How Personal Information is Collected About You
We collect personal information directly from you when you provide it to us, when you provide it to Workday or other human resources systems, when you apply for a position with AAI, and from our vendors and recruiters.
We also collect personal information using technology to monitor, protect and manage AAI networks, AAI systems, and AAI information, as well as using technology to discover processes which could be automated.
If you visit an Automation Anywhere website or interact with an AAI advertisement, we or our partners may use cookies, web beacons, clear GIF, pixels, internet tags, web server logs, and other data collection tools as further elaborated upon in our Automation Anywhere Website Privacy Policy.
How AAI Uses Your Personal Information
Human resources and Personnel functions for job applicants such as to recruit and evaluate job applicants and candidates for employment, obtain employment references, conduct background checks, reach your emergency contacts or provide medical care to you in the event of an emergency, and workforce administration and planning.
Human resources and Personnel functions for new and existing Personnel such as onboarding; communication; timekeeping, payroll, bonus, taxation, business reimbursements, and expense report administration; business travel; managing and administering AAI compensation programs, including, but not limited to, equity; employee benefits; training and development; performance evaluations; managing sick or disability leaves; managing personal time off; obtaining and providing employment references; creating, maintaining and servicing online employee accounts; prevent, detect, and prosecute fraud and other unlawful activity; verification purposes; workers’ compensation claims; career planning; personnel surveys; conducting background checks and other employment screening; coordinating internal events and facilitating Personnel appreciation; reaching your emergency contacts in the event of an emergency; provide Personnel with, or obtain for Personnel, medical care in the event Personnel is injured or become ill while on-site at one of AAI’s facilities or at an AAI event; workforce administration and planning, including capacity utilization planning, staffing and resource allocation; and maintaining a corporate directory.
Personnel health and safety such as for public health reporting and disease preventing; health screening; Covid and other serious communicable disease exposure notifications; COVID-19 diagnosis and vaccination related information (and any diagnosis or vaccination related information for any other serious communicable disease).
Security, compliance, and business continuity such as to manage, protect and monitor employee access to AAI facilities, equipment, systems, and information to ensure compliance with applicable laws, regulatory requirements, and applicable AAI policies and procedures; conduct internal audits and workplace investigations; investigate potential breaches of and enforce compliance with AAI policies and procedures; detect security incidents; protect against malicious, deceptive, fraudulent or illegal activity and to prosecute those responsible for that activity; promote safe, secure and efficient use of messaging (e.g., email and other messaging platforms) and the Internet using AAI’s resources or in the scope of work for AAI, including ensuring that business-critical information and assets of AAI are protected and secure; ensure business continuity including, for example, providing access to business email accounts to other AAI employees during a leave of absence or after the termination of employment; prevent, detect, and prosecute fraud and other unlawful activity; and accept, manage and address information submitted through the whistleblower hotline.
Benchmarking and Analytics such as to facilitate and evaluate our equality opportunity and diversity initiatives and obligations; perform workplace analytics, data analytics and benchmarking; manage requirements by state or federal government laws or government contracting requirements.
Corporate and Legal Activities such as complying with applicable laws and regulations; maintaining commercial insurance policies and coverages; engaging in potential corporate transactions (e.g., merger, acquisition, joint venture, funding) requiring review of employee records; administering and maintaining AAI’s operations (e.g., for safety purposes); exercising or defending the legal rights of AAI and its employees, contractors and agents; preventing, detecting, and prosecuting fraud and other unlawful activity; complying with government contracting reporting requirements; marketing AAI to customers and potential customers in the ordinary course of business; discovering and automating processes; and improving our product offerings and services.
All of these processing purposes are necessary for maintaining the relationship we have with you.
Transfers of personal data
We can communicate or transfer your personal data to different entities, for the purposes established in this Privacy Notice. These transfers are made to the extent that they are necessary for the maintenance or fulfillment of the legal relationship we have with you. It is noted that any of the transfers referred to below can be of a national or international nature.
Data submissions
We can send all or part of your personal data to service providers that support us in any process. These providers include, for example: (i) companies that provide us with any recruitment and selection services; (ii) accounting or IT companies that support us to make the payroll; (iii) companies or laboratories that perform psychometric, psychological tests, medical, clinical studies, among others; (iv) firms that support us in accounting, tax, legal and immigration matters; and (v) insurance agents and insurers; Before we transfer information to these providers, we make sure to sign contracts that allow these companies to commit to protecting the personal data of our employees and partners.
Transfers of personal data to our affiliates
As we are a part of an international group, your personal data may be communicated or transferred to other companies in our same corporate group, which may be located in Mexico or abroad. Our affiliates make reasonable efforts to implement measures and policies to protect the personal data of our employees; These policies are consistent with ours and are designed to comply with the provisions of the personal data protection laws of each country.
Transfers of personal data to third parties
Your personal data may be communicated or transferred to a third party other than the above in certain cases; We will only transfer your data when we have your consent or when it is not necessary for the transfer in terms of article 37 of the FDPL. You specifically accept that his data be transferred to third parties in the following cases: (i) when we must transfer the data to the competent authorities, including social security, tax, labor, those in charge of procurement justice, among others; (ii) those made to the union of which the employee is a member when so requested by the employee or the union, or when the transfer is necessary to comply with the law; (iii) to insurers, banks and other companies when necessary to comply with contractual or legal obligations; and (iv) when the data needs to be transferred to a third party in the context of a corporate transaction (including mergers, acquisitions, among others). In these cases, the companies that could receive your information are the potential acquirers and the advisers (legal, accounting or financial, among others) that participate in the transaction. We will only communicate your personal data to said third parties to the extent that such communication is necessary to evaluate or complete the transaction (e.g., to facilitate an adequate employer substitution).
Means available to Individuals to exercise their rights regarding Personal Data
All of our Employees and Contractors will have, at all times, the right to request access their personal data and/or rectification thereof. Likewise, you may request that your data be cancelled, oppose processing said data for specific purposes and/or revoke the consent that you have previously given us to process your data for a specific purpose (the "ARCO Rights "). Please consider that your ARCO Rights are subject to the limitations established by law. To exercise your ARCO Rights, please follow the instructions under Access Your Personal Data on our publicly posted website privacy policy found here: https://www.automationanywhere.com/legal/privacy.
Your request must contain at least the following: (i) your full name and surname, full address and email, in which the corresponding response will be communicated; (ii) attach the documents that duly prove your identity, or where appropriate, the representation of the same under oath to tell the truth. For this, only a copy of both sides of your current voter's credential and/or a copy of the current passport will be accepted as identity documents; and (iii) the detailed, clear and precise description of the personal data with respect to which you wish to exercise any of the aforementioned rights.
In the case of exercising the right of rectification, the documentation that proves your request must be attached.
We will have a period of no more than 20 (twenty) days from the day after receipt of the corresponding request, to respond to you.
Options available to you to limit our use or disclosure of your personal data
You may at some point want to explore whether there are ways to limit how we use or disclose your personal data in any particular way. For example, an employee may request that their photograph not be published on our internal network or in a Company catalog; a former employee could request that we not give reference to him, etc. In these cases, or in any other in which you wish to explore what ways exist so that we do not process your data for a particular purpose, please contact us at the email address referenced in the Contact Information section below. We will let you know what options you have.
Changes to this Privacy Notice.
This Privacy Notice may be amended consistent with the requirements of applicable law. When AAI updates this Privacy Notice, it will also revise the “Last Updated” date at the top of this document. Check back periodically as we will make updates to this Privacy Notice and revise the date updated to indicate the date last updated. Furthermore, AAI will notify Personnel regarding any material changes to this Privacy Notice. The Privacy Notice will be posted on AAI’s intranet.

Salud y seguridad del Personal, con los siguientes fines: notificación de salud pública y prevención de enfermedades; exámenes médicos; notificaciones de exposición al COVID y a otras enfermedades transmisibles graves; información relacionada con el diagnóstico y la vacunación de COVID-19 (y cualquier diagnóstico o información relacionada con la vacunación para cualquier otra enfermedad transmisible grave).
Seguridad, cumplimiento y continuidad de las actividades con los siguientes fines: gestionar, proteger y supervisar el acceso de los empleados a las instalaciones, equipos, sistemas e información de AAI para garantizar el cumplimiento de la legislación, los requisitos normativos y las políticas y procedimientos aplicables de AAI; realizar auditorías internas e investigaciones en el lugar de trabajo; investigar posibles infracciones de las políticas y procedimientos de AAI e imponer su cumplimiento; detectar incidentes de seguridad; proteger contra actividades maliciosas, engañosas, fraudulentas o ilegales y perseguir a los responsables de dichas actividades; promover el uso seguro y eficiente de la mensajería (por ejemplo, correo electrónico y otras plataformas de mensajería) e Internet utilizando los recursos de AAI o en el ámbito de trabajo de AAI, incluida la garantía de que la información y los activos esenciales para la actividad de AAI están protegidos y seguros; garantizar la continuidad de la actividad, incluida, por ejemplo, la entrega de acceso a cuentas de correo electrónico empresariales a otros empleados de AAI durante una licencia o después de un despido; prevenir, detectar y perseguir las actividades fraudulentas o ilegales; y aceptar, administrar y enviar información obtenida desde la línea directa de denuncias.

Actividades empresariales y legales, con los siguientes fines: cumplir las leyes y normativas aplicables; mantener las pólizas y coberturas de seguros comerciales; participar en posibles transacciones empresariales (por ejemplo, fusión, adquisición, empresa conjunta o financiación) que requieran la revisión de los registros de los empleados; administrar y mantener las operaciones de AAI (por ejemplo, con fines de seguridad); ejercer o defender los derechos legales de AAI y sus empleados, contratistas y agentes; prevenir, detectar y perseguir el fraude y otras actividades ilícitas; cumplir los requisitos de presentación de informes de contratación del Gobierno; comercializar AAI a clientes y clientes potenciales en el curso ordinario de los negocios; descubrir y automatizar procesos; y mejorar nuestras ofertas de productos y servicios.
Todas estas finalidades de tratamiento son necesarias para mantener nuestra relación con usted.
Transferencia de datos personales
Podemos comunicar o transferir sus datos personales a diferentes entidades, para los fines establecidos en el presente Aviso de privacidad. Estas transferencias se realizan en la medida en que sean necesarias para el mantenimiento o cumplimiento de nuestra relación jurídica con usted. Cabe señalar que cualquiera de las transferencias mencionadas a continuación puede tener carácter nacional o internacional.
Envío de datos
Podemos enviar todos o parte de sus datos personales a proveedores de servicios que nos asistan en cualquier proceso. Entre estos proveedores figuran, por ejemplo: (i) empresas que nos prestan servicios de reclutamiento y selección; (ii) empresas de TI o contables que nos asisten para realizar la nómina; (iii) empresas o laboratorios que realizan evaluaciones psicométricas, psicológicas, médicas, estudios clínicos, entre otros; (iv) despachos que nos asisten en materia contable, fiscal, legal y migratoria; y (v) agentes de seguros y aseguradoras. Antes de transferirles información a estos proveedores, nos aseguramos de firmar contratos en los que estas empresas se comprometan a proteger los datos personales de nuestros empleados y socios.
Transferencia de datos personales a nuestras filiales
Al formar parte de un grupo internacional, sus datos personales pueden ser comunicados o transferidos a otras empresas de nuestro mismo grupo corporativo, las cuales pueden estar ubicadas en México o en el extranjero. Nuestras filiales se esfuerzan, dentro de lo razonable, en aplicar medidas y políticas para proteger los datos personales de nuestros empleados. Estas políticas son coherentes con las nuestras y están diseñadas para cumplir las disposiciones de las leyes de protección de datos personales de cada país.
Transferencia de datos personales a terceros
Sus datos personales podrán ser comunicados o transferidos a terceros distintos de los ya mencionados en determinados casos. Solo transferiremos sus datos cuando contemos con su consentimiento o cuando no sea necesario para la transferencia en los términos del artículo 37 de la FDPL. Usted acepta expresamente que sus datos sean transferidos a terceros en los siguientes casos: (i) cuando debamos transferir los datos a las autoridades competentes, incluyendo las de seguridad social, fiscales, laborales, las encargadas de la procuración de justicia, entre otras; (ii) al sindicato al que pertenezca el empleado cuando así lo solicite el empleado o el sindicato, o cuando la transferencia sea necesaria para cumplir con la ley; (iii) a aseguradoras, bancos y otras empresas cuando sea necesario para cumplir con obligaciones contractuales o legales; y (iv) cuando sea necesario transferir los datos a un tercero en el contexto de una transacción corporativa (incluyendo fusiones, adquisiciones, entre otras). En estos casos, las empresas que podrían recibir su información son los posibles adquirentes y los asesores (jurídicos, contables o financieros, entre otros) que participan en la transacción. Solo comunicaremos sus datos personales a dichos terceros en la medida en que sea necesario para evaluar o completar la transacción (por ejemplo, para facilitar una sustitución adecuada del empleador).
Medios disponibles para ejercer sus derechos en relación con los datos personales
Todos nuestros Empleados y Contratistas tendrán, en todo momento, derecho a solicitar el acceso a sus datos personales y/o la rectificación de los mismos. Asimismo, usted podrá solicitar la cancelación de sus datos, oponerse al tratamiento de los mismos para fines específicos y/o revocar el consentimiento que previamente nos haya otorgado para el tratamiento de sus datos para un fin específico (los “derechos ARCO”). Tenga en cuenta que sus derechos ARCO están sujetos a las limitaciones establecidas por la ley. Your personal data is important to us. This Privacy Notice (“Notice”) explains how your personal data is processed by AAI and its subsidiaries in the countries in which we operate, your personal data protection rights in accordance with the applicable law, and how to exercise them. Personal Data AAI May Collect About You
Identifying data which you provide to us: name, title, telephone number, age, date of birth, signature, driver’s license number or other state identification number, passport number, social security number, bank account number, secondary health insurance information (if applicable), mailing address, and email address, citizenship, marital status, household information and veteran or military status.
Demographic and physical data, some of which is protected as sensitive personal data: race, national origin, religion or creed, medical condition, pregnancy and related medical conditions, vaccination status, physical or mental disability, gender identity and sex.
Video, voice and image data, subject to the requirements of local law and internal policy.
Where applicable, device information, geolocation, and other unique identifiers that we or AAI systems, AAI network, or AAI agents (such as OKTA) collect about you such as physical location or movements, internet protocol address or any other unique number assigned to identify the device, when a device is used to access AAI information, AAI network, AAI systems, or a website belonging to AAI.
Where applicable, activity performed on an AAI owned network or device such as browser type and version, applications installed and usage patterns, software updates installed, browser history, search history, email content, other electronic communication content, file and document content, keystrokes, clicks and other navigational patterns, desktop screen shots and other information regarding Personnel’s interaction with an internet website, AAI computer, AAI’s network, systems, or AAI information. Employees and contractors can refer to the Automation Anywhere Information Technology Acceptable Use Policy and Process Discovery FAQs for more information.
In view of the possibility of monitoring the communications exchanged on an AAI owned network or device, at any time, at the discretion of the Company, it is recommended that you avoid using the corporate systems for communications and purposes of a private nature and personal communications that contain Personal Data and/or Sensitive Personal Data of third parties. In other words, we suggest that you avoid using corporate e-mail to send messages of a private nature and for purposes unrelated to the exercise of your function.
Where applicable, activity performed on a non-AAI owned device on which you have installed AAI’s mobile device management (MDM) such as device type used to access AAI network, AAI systems or AAI information, device identifier including device name, model, serial number, storage amount total and free, IMEI, MAC address, and operating system, AAI-managed applications installed on the device and the information and activities therein. Please note that AAI does not collect your browsing history, calling history, text messages, contacts, passwords to personal accounts, content in your personal applications, personal calendar events, or photos from the non-AAI owned device.
Where applicable, facility security data such as facility access data, on-premises video monitoring, and photo IDs used for identity verification and security purposes.
Job applicant and other Personnel onboarding information not previously addressed such as education history; job preferences; information obtained during reference checks, legally permissible background checks or other screenings; information from publicly available sources, such as LinkedIn; emergency contacts; and employment information including your employment history, language skills and professional qualifications, any other information included on your resume or CV. Additionally, for Personnel onboarding, information provided to AAI such as year to date 401k contributions; tax forms for payroll deductions; whether you were referred to AAI by a specific job website or person; any security, discrimination, harassment, facility or other training taken through AAI vendors during your relationship with AAI; and opinions collected while answering any voluntary surveys sent to you by AAI.
How Personal Information is Collected About You
We collect personal information directly from you when you provide it to us, when you provide it to Workday or other human resources systems, when you apply for a position with AAI, and from our vendors and recruiters.
We also collect personal information using technology to monitor, protect and manage AAI networks, AAI systems, and AAI information, as well as using technology to discover processes which could be automated.
If you visit an Automation Anywhere website or interact with an AAI advertisement, we or our partners may use cookies, web beacons, clear GIF, pixels, internet tags, web server logs, and other data collection tools as further elaborated upon in our Automation Anywhere Website Privacy Policy.

How AAI Uses Your Personal Information
Human resources and Personnel functions for job applicants such as to recruit and evaluate job applicants and candidates for employment, obtain employment references, conduct legally permissible background checks, reach your emergency contacts or provide medical care to you in the event of an emergency, and workforce administration and planning.
Human resources and Personnel functions for new and existing Personnel such as onboarding; communication; timekeeping, payroll, bonus, taxation, business reimbursements, and expense report administration; business travel; managing and administering AAI compensation programs, including, but 8 not limited to, equity; employee benefits; training and development; performance evaluations; managing sick or disability leaves; managing personal time off; obtaining and providing employment references; creating, maintaining and servicing online employee accounts; prevent, detect, and prosecute fraud and other unlawful activity; verification purposes; workers’ compensation claims; career planning; personnel surveys; conducting background checks and other employment screening; coordinating internal events and facilitating Personnel appreciation; reaching your emergency contacts in the event of an emergency; provide Personnel with, or obtain for Personnel, medical care in the event Personnel is injured or become ill while on-site at one of AAI’s facilities or at an AAI event; workforce administration and planning, including capacity utilization planning, staffing and resource allocation; and maintaining a corporate directory
Personnel health and safety such as for public health reporting and disease preventing; health screening; Covid and other serious communicable disease exposure notifications; COVID-19 diagnosis and vaccination related information (and any diagnosis or vaccination related information for any other serious communicable disease).
Security, compliance, and business continuity such as to manage, protect and monitor employee access to AAI facilities, equipment, systems, and information to ensure compliance with applicable laws, regulatory requirements, and applicable AAI policies and procedures; conduct internal audits and workplace investigations; investigate potential breaches of and enforce compliance with AAI policies and procedures; detect security incidents; protect against malicious, deceptive, fraudulent or illegal activity and to prosecute those responsible for that activity; promote safe, secure and efficient use of messaging (e.g., email and other messaging platforms) and the Internet using AAI’s resources or in the scope of work for AAI, including ensuring that business-critical information and assets of AAI are protected and secure; ensure business continuity including, for example, providing access to business email accounts to other AAI employees during a leave of absence or after the termination of employment; prevent, detect, and prosecute fraud and other unlawful activity; and accept, manage and address information submitted through the whistleblower hotline.
Benchmarking and Analytics such as to facilitate and evaluate our equality opportunity and diversity initiatives and obligations; perform workplace analytics, data analytics and benchmarking; manage requirements by state or federal government laws or government contracting requirements.
Corporate and Legal Activities such as complying with applicable laws and regulations; maintaining commercial insurance policies and coverages; engaging in potential corporate transactions (e.g., merger, acquisition, joint venture, funding) requiring review of employee records; administering and maintaining AAI’s operations (e.g., for safety purposes); exercising or defending the legal rights of AAI and its employees, contractors and agents; preventing, detecting, and prosecuting fraud and other unlawful activity; complying with government contracting reporting requirements; marketing AAI to customers and potential customers in the ordinary course of business; discovering and automating processes; and improving our product offerings and services.
Data submissions
We can send all or part of your personal data to service providers that support us in any process. These providers include, for example: (i) companies that provide us with any recruitment and selection services; (ii) accounting or IT companies that support us to make the payroll; (iii) companies or laboratories that perform psychometric, psychological tests, medical, clinical studies, among others; (iv) firms that support us in accounting, tax, legal and immigration matters; and (v) insurance agents and insurers; Before we 9 transfer information to these providers, we make sure to sign contracts that allow these companies to commit to protecting the personal data of our employees and partners.
Transfers of personal data to our affiliates
As we are a part of an international group, your personal data may be communicated or transferred to other companies in our same corporate group, which may be located in Brazil or abroad. Our affiliates make reasonable efforts to implement measures and policies to protect the personal data of our employees. These policies are consistent with ours and are designed to comply with the provisions of the personal data protection laws of each country.
Transfers of personal data to third parties
Your personal data may be communicated or transferred to a third party other than the above in certain cases. We will transfer your data as described herein or otherwise in a legally permissible manner. You specifically are aware that your data be transferred to third parties in the following cases: (i) when we must transfer the data to the competent authorities, including social security, tax, labor, those in charge of procurement justice, among others; (ii) those made to the union of which the employee is a member when so requested by the employee or the union, or when the transfer is necessary to comply with the law; (iii) to insurers, banks and other companies when necessary to comply with contractual or legal obligations; and (iv) when the data needs to be transferred to a third party in the context of a corporate transaction (including mergers, acquisitions, among others). In these cases, the companies that could receive your information are the potential acquirers and the advisers (legal, accounting or financial, among others) that participate in the transaction. We will only communicate your personal data to said third parties to the extent that such communication is necessary to evaluate or complete the transaction (e.g., to facilitate an adequate employer substitution).
Means available to Individuals to exercise their rights regarding Personal Data
All Personnel will have, at all times, the following rights: (i) confirmation of the existence of the processing; (ii) access to the data; (iii) correction of incomplete, inaccurate or out-of-date data; (iv) anonymization, blocking or deletion of unnecessary or excessive data or data processed in noncompliance with the provisions of the LGPD; (v) portability of the data to another service provider or product provider, by the means of an express request, pursuant with the regulations of the national authority, and subject to commercial and industrial secrets; (vi) deletion of personal data processed with the consent of the data subject; (vii) – information about public and private entities with which the controller has shared data; (viii) information about the possibility of denying consent and the consequences of such denial; (ix) revocation of consent; and (x) review of decisions made solely based on automated processing of personal data. You will be asked to verify your identity and attach documents that establish the same. No more data than is necessary will be required.
In the case of exercising the right of rectification, the documentation that proves your request must be attached.

Tendo em vista a possibilidade de monitorar as comunicações trocadas em rede ou dispositivo de propriedade da AAI, a qualquer momento, a critério da Empresa, recomenda-se que você evite utilizar os sistemas corporativos para comunicações e finalidades de natureza privada e comunicações pessoais que contenham Dados Pessoais e/ou Dados Pessoais Sensíveis de terceiros. Quando aplicável, atividades realizadas em um dispositivo que não seja de propriedade da AAI no qual você instalou o gerenciamento de dispositivos móveis (MDM) da AAI, como tipo de dispositivo usado para acessar a rede da AAI, sistemas da AAI ou informações da AAI, identificador do dispositivo, incluindo nome do dispositivo, modelo, número de série, quantidade de armazenamento total e gratuita, IMEI, endereço MAC e sistema operacional, aplicativos gerenciados pela AAI instalados no dispositivo e as informações e atividades neles contidas. Esses provedores de serviço incluem, por exemplo: (i) empresas que nos prestam quaisquer serviços de recrutamento e seleção; (ii) empresas de contabilidade ou TI que nos dão suporte na elaboração da folha de pagamento; (iii) empresas ou laboratórios que realizam testes psicométricos, psicológicos, estudos médicos, clínicos, entre outros; (iv) empresas que nos dão suporte em questões contábeis, fiscais, jurídicas e de imigração; e (v) agentes e seguradoras de seguros. Antes de transferirmos informações para esses fornecedores, assinamos contratos que permitem que essas empresas se comprometam a proteger os dados pessoais de nossos funcionários e parceiros.
Transferências de dados pessoais para nossas afiliadas
Por fazermos parte de um grupo internacional, seus dados pessoais poderão ser informados ou transferidos para outras empresas do nosso mesmo grupo societário, que podem estar localizadas no Brasil ou no exterior. Nossas afiliadas envidam esforços razoáveis para implementar medidas e políticas a fim de proteger os dados pessoais de nossos funcionários. Estas políticas são consistentes com as nossas e foram elaboradas para cumprir as disposições das leis de proteção de dados pessoais de cada país.
Transferências de dados pessoais para terceiros
Seus dados pessoais podem ser comunicados ou transferidos a terceiros que não os acima mencionados em determinados casos. Transferiremos seus dados conforme descrito aqui ou de outra forma legalmente permitida. Você especificamente está ciente de que seus dados serão transferidos a terceiros nos seguintes casos: (i) quando devemos transferir os dados para as autoridades competentes, incluindo seguro social, fiscal, laboral, aqueles responsáveis pela justiça em aquisições, entre outras; (ii) transferências de dados para o sindicato do qual o empregado é membro quando solicitado pelo empregado ou pelo sindicato, ou quando a transferência for necessária para o cumprimento da lei; (iii) a seguradoras, bancos e outras empresas quando necessário para cumprimento de obrigações contratuais ou legais; e (iv) quando os dados precisarem ser transferidos a terceiros no contexto de uma transação societária (incluindo fusões, aquisições, entre outras). Nestes casos, as empresas que poderão receber as suas informações são os potenciais adquirentes e os consultores (jurídicos, contábeis ou financeiros, entre outros) que participam na transação. Somente comunicaremos seus dados pessoais a terceiros na medida em que tal comunicação seja necessária para avaliar ou concluir a transação (por exemplo, para facilitar uma substituição adequada do empregador).
Meios à disposição dos indivíduos para exercerem seus direitos com relação aos dados pessoais
Toda a equipe terá, em todos os momentos, os seguintes direitos: (i) confirmação da existência do processamento; (ii) acesso aos dados; (iii) correção de dados incompletos, imprecisos ou desatualizados; (iv) anonimização, bloqueio ou exclusão de dados desnecessários, excessivos ou processados em descumprimento do disposto na LGPD; (v) portabilidade dos dados para outro provedor de serviços ou fornecedor de produto, mediante solicitação expressa, nos termos da regulamentação da autoridade nacional, e respeitados os segredos comerciais e industriais; (vi) exclusão de dados pessoais processados com consentimento do titular dos dados; (vii) – informações sobre entidades públicas e privadas com as 5 quais o controlador tenha compartilhado dados; (viii) informações sobre a possibilidade de negar o consentimento e as consequências de tal negação; (ix) revogação do consentimento; e (x) revisão de decisões tomadas exclusivamente com base no processamento automatizado de dados pessoais.
