1. Data Protection Standards & Legal Frameworks

   Your data will be processed within the European Economic Area (EEA) and protected under the General Data Protection Regulation (GDPR). We strive to ensure compliance through established, legal safeguards:

   • United States: You are choosing to move your data to EU-based servers. While this provides data residency within the EU, Automation Anywhere remains a U.S. entity and will process your data according to our GDPR-compliant Data Processing Agreement.
   • Adequacy Recognition: For customers in  Argentina,  Canada, and  Japan, the EU is officially recognized by your local regulators as providing a level of data protection equivalent to your home country.
   • Contractual Safeguards: For customers in Brazil, Chile, Mexico, Singapore, Australia, and Colombia, we implement Standard Contractual Clauses (SCCs) – including the specific 2024 ANPD clauses for Brazil – to help ensure compliance with your local laws (e.g., LGPD, Law 21.719, PDPA, Privacy Act).
   • India (DPDP Act): You authorize this transfer under Section 16 of the DPDP Act 2023 and warrant that you have the necessary, legal basis for offshore processing.

2. Sensitive & Medical Data Warranty

   If your data contain  special category/sensitive information (such as health or medical records), you represent and warrant that:

   • You have obtained explicit, informed, and unambiguous consent from individual data subjects for this transfer, satisfying GDPR Article 9 and your local sensitive data laws.
   • The data are not subject to local, residency mandates (e.g., Australia’s My Health Records Act) that strictly prohibit any offshore processing.
   • You acknowledge that once data are in the EU, they are subject to the rights and protections of the GDPR, including strict, purpose limitation and the "right to be forgotten".
